1. Acceptance of Terms

The services that Webfriends Pty Ltd ("we/our" and trading as and below known as “PennyWise Investment”) provides to you are subject to the following Terms and Conditions (“Terms”).

By using and/or visiting our website, you signify your agreement to these Terms and our Privacy Policy, located at http://www.pennywiseinvestment.com.au ("the website").  A reference to “you”, “your” or “user/s” is a reference to any person, company or entity that accesses and/or uses our website and/or requires our services.

The term 'Service' refers to all services advertised on and provided through www.pennywiseinvestment.com.au by PennyWise Investment.

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Our Services

PennyWise Investment provides general financial product advice to both wholesale and retail clients. We reserve the right to modify or terminate the services for any reason, without notice at any time. 

3. Subscription payment and renewal process

Some services provided require purchase of an annual subscription. The payment system and account details are accessible at all times to enable a prompt extension of a subscription or purchase extra services.

Subscriptions fees are as follows:

PennyWise Portfolio Report $295 per year (delivered each Wednesday morning)

Delivery of these reports will be in electronic form, via an email to subscribers that will provide a link to a password protected area of the PennyWise Investment website where these reports can be read. These reports will also be able to be printed from the website. 

The fees quoted below are in Australian dollars and include GST (as defined in Section 195.1 of the A New Tax System (Goods and Services Tax) Act 1999).

Payment is required in advance. Credit or Direct Debit cards are the only accepted form of online payment.  This site supports secured sockets layer (SSL) based transactions from a browser to the level of 128 bit or greater.

Subscriptions to any or all services are for an initial term of 12 months (or “initial term”), after which this Agreement will automatically be renewed – subject to terms noted below - for successive periods of 12 months on the same terms and conditions of this Agreement.

You may terminate the automatic renewal of your subscription at anytime by sending an email to PennyWise Investment at least 7 days prior to the renewal date.

An email will be also automatically sent out one month prior to the anniversary date of your membership, giving you the option to renew or cancel your subscription prior to the renewal date. A reminder email will be sent 7 days prior to the renewal date if you have not indicated your preferred option by that time.

If there is no response prior to the renewal date, your subscription will be automatically renewed one day after the renewal date. It is your responsibility to ensure that there are sufficient clear funds available in your nominated credit card account to cover payments.

If there are insufficient funds, your subscription will instead be automatically terminated, and an email sent notifying you of the fact and inviting you to renew.

4. 4-week free trial period

First time subscribers are invited to trial the service for four weeks. After the first four weeks, and following payment of the annual subscription, no refunds will ordinarily be given, unless your subscription is part of another special trial offer as advertised on the website.

5. Non-commercial and non-transferable service

You agree to use the Service solely for your own non-commercial use and/or for the purposes of advising your own financial planning clients. Otherwise you agree not to use the Service for resale or other transfer or disposition to, or use by or for the benefit of, any other person or entity.

You agree not to use, transfer, distribute or dispose of any information provided by or contained in the Service in any manner that could compete with the business of PennyWise Investment as a provider of general financial product advice to wholesale and retail clients.

You agree to notify PennyWise Investment in writing promptly upon becoming aware of any unauthorized access or use of the Service by any party or of any claim that the Service infringes upon any copyright, trademark or other contractual, statutory or common law rights.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by PennyWise Investment at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

6. Disclaimer

The materials on PennyWise Investment's web site are provided "as is". PennyWise Investment makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations

In no event shall PennyWise Investment or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on PennyWise Investment's Internet site, even if PennyWise Investment or a PennyWise Investment authorized representative has been notified orally or in writing of the possibility of such damage.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

9. Revisions and Errata

The materials appearing on PennyWise Investment's web site could include technical, typographical, or photographic errors. PennyWise Investment does not warrant that any of the materials on its web site are accurate, complete, or current. PennyWise Investment may make changes to the materials contained on its web site at any time without notice.

10. Links

PennyWise Investment has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by PennyWise Investment of the site. Use of any such linked web site is at the user's own risk.

11. Site Terms of Use Modifications

PennyWise Investment may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

12. Governing Law

Any claim relating to PennyWise Investment's web site shall be governed by the laws of the State of NSW without regard to its conflict of law provisions.
